Zoning Department

Palmyra Township is a zoned community to promote the safety, health, comfort, morals, and general welfare of the Township. Zoning is a locally enacted law that regulates and controls the use of private property.

Ohio Revised Code requires that the Palmyra Township Board of Trustees establish two Zoning Boards. First is the Zoning Commission. The Commission prepares the Zoning Resolution, takes action on rezoning requests, and makes recommendations to the Palmyra Township Board of Trustees. The Zoning Commission may also initiate rezoning, or changes in the text of the Zoning Resolution, for promotion of the best interests of the community.

Second is the Zoning Board of Appeals. The Zoning Board of Appeals decisions must be appealed by the Portage County Court of Common Pleas. It is empowered to preform four tasks:

  1. to hear various requests from specfic zoning standards, where, due to special conditions of the land, literal enforcement of those standards is alleged to cause a hardship to a property owner.
  2. to hear requests for conditional uses - uses which may not be detrimental to surrounding properties, but might more intensely affect those properties
  3. to hear and decide appeals where it is alleged that there is an error in any order, requirement, decision, or determination made by the Zoning Inspector in the enforcement of the Zoning Resolution
  4. to hear requests for changes in non-conforming uses

The Zoning Inspector, appointed by the Palmyra Township Board of Trustees, is responsible for the Zoning Department and for the enforcement of the Zoning Resolution.

Property owners considering improvement or alterations to homes or business properties should contact the Zoning Inspector to discuss plans and to determine if a permit or other approval is required by Palmyra Township.  Effective June 21, 2006 the Zoning Inspector will be available at the Palmyra Township Fire Department on Wednesday mornings from 9:00 AM to Noon. Zoning Commission meetings are open to the public and are held at the Palmyra Township Fire Department located at 3956 State Route 225 on the second Thursday of each month at 7:00 PM.

The Palmyra Township Zoning Commission is delegated a range of powers under Chapter 519 of the Ohio Revised Code. However, they are not empowered to adopt plans. They may use planning consultants, other professionals, and other public officials to assist them in drawing up a comprehensive set of zoning regulations or amendments to the existing regulations. They may then recommend the zoning regulations or amendments they drafted to the Palmyra Township Board of Trustees for adoption subsequent to a public hearing.

Like the Zoning Board of Appeals, the Zoning Commission consists of five members, two alternates, and a board secretary. The Zoning Commission are residents of the Township who are appointed by the Board of Trustees for a five year term. Member appointments are staggered so one term expires each year. The Palmyra Township Zoning Board of Appeals authority is established under Section 519 of the Ohio Revised Code. Local zoning regulations require the Zoning Board of Appeals to establish a set of rules and procedures for guiding the conduct of hearings and to provide standards by which the substance of testimony and other evidence is offered and judged.

The Zoning Board of Appeals quasi-judicial function arises from its authority to hear and decide appeals. It is the first step that an individual may take to appeal a decision made by the Zoning Inspector or to request a variance from a standard within the zoning regulations as it applies to their property. The Zoning Board of Appeals will usually be able to resolve any conflict and, if not, the next step for the aggrieved party is the Portage County Court of Common Pleas.

If you want an appeal you must have all your information into the Zoning Inspector by the 7th of the month to be on the agenda for the following month.

The Zoning Board of Appeals also has the authority to grant variances from the strict terms of the zoning regulations where unnecessary hardship would otherwise result. Members of the Board of Appeals must realize the problems which would result in eroding the zoning regulations through the granting of an excessive number of variances. The Zoning Board of Appeals does not have the authority to make changes in the zoning resolution or map.

Review of applications for conditional use permits are also a function of the Zoning Board of Appeals to insure that all the required standards and conditions for the placement of the conditional use in a particular district have been met.
